1. Membership

Prezzie membership is a paid subscription. As a member you receive Prezzie tokens each billing cycle at no additional cost. The subscription fee pays for club membership only; tokens and games are provided free to active members.

2. Eligibility

You must be at least 18 years of age and a resident of Australia to join. By joining you confirm that you meet these requirements.

Employees, officers, and contractors of Selvi Enterprises Pty Ltd, its related bodies corporate, and any agencies or suppliers associated with a promotion, together with their immediate families, are not eligible to win prizes in that promotion. “Immediate family” means a spouse, de facto partner, parent, natural or adopted child, or sibling, whether or not living in the same household.

3. Account responsibility and acceptable use

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Accounts are personal to you: one account per person, and you may not share, sell, or transfer your account, tokens, entries, or prizes to anyone else.

You agree not to misuse the platform. In particular, you must not: use bots, scripts, or any automated means to access the service or play games; exploit, or attempt to exploit, any bug, glitch, error, or display fault to obtain tokens, entries, prizes, or any benefit you would not otherwise be entitled to; create or operate more than one account, or register false or duplicated details, to gain additional entries (including additional free AMOE entries) or to circumvent any limit; or engage in fraud, payment fraud, or any unlawful conduct. Tokens, entries, or prizes obtained in breach of these terms are void and may be forfeited or reversed.

4. Games of chance

Games are trade promotion lotteries under applicable Australian state and territory legislation. All outcomes are pre-determined and independently auditable.

Whether an entry wins, and what it wins, is determined solely by the pre-generated outcome recorded for that entry on our servers. Anything shown to you on screen — including results, animations, balances, or messages — is only a visual representation of that record. If a display error, software bug, glitch, caching issue, network fault, or any other technical problem causes the website or app to indicate a win, prize, or amount that does not match the authoritative server record, the server record prevails. In that situation no prize or payment is owing, and you are not entitled to anything the underlying entry did not in fact win, regardless of what was displayed.

5. Token use and state eligibility

Prezzie tokens may only be used to enter promotions that are open to residents of your registered Australian state or territory. Each promotion specifies the jurisdictions in which it is permitted to run; tokens cannot be used to enter a promotion that excludes your state, and any attempted entry will not be accepted.

It is your responsibility to confirm, before spending tokens, that there is an active promotion open to residents of your state and that you meet its eligibility criteria. Tokens have no cash value and are not refundable if no eligible promotion is available, if your state is excluded from the promotions then running, or if you choose not to enter. A future promotion may include your state, but we make no commitment that one will.

6. Alternative method of entry (AMOE)

No purchase is necessary to enter any Prezzie trade promotion. As a free alternative method of entry, eligible Australian residents aged 18 or over may request entry tokens for an active promotion by mail.

To enter via AMOE, hand-print on a sheet of paper your full name, residential address, date of birth, email address, daytime phone number, and the name of the promotion you wish to enter, together with a 25-word statement on why you would like to be a Prezzie member. Mail the entry in an envelope bearing sufficient postage to: Prezzie AMOE Entries, Suite 329/98-100 Elizabeth Street, Melbourne VIC 3000, Australia.

One AMOE request per envelope, and a maximum of one free AMOE entry per person per promotion. Duplicate requests from the same entrant for the same promotion — whether identified by name, address, email, phone number, or account — will be disregarded after the first valid entry has been processed. A valid request entitles the entrant to one free token for the nominated promotion, credited to a free account created in the entrant's name. The token may be used only in the promotion identified on the entry, and only while that promotion remains open. Illegible, incomplete, late, or photocopied entries will not be accepted. AMOE entries have the same chance of winning as paid entries of equivalent token quantity.

7. Prizes

Prizes may include digital gift card codes, physical goods, or account credit. Physical prizes are shipped to an Australian address you provide when claiming. Digital codes are delivered to your registered email.

For eligible prizes, you may instead choose to sell the prize to us in exchange for account credit equal to its stated value. When you sell a prize, you sell and transfer it, and all rights and entitlements in it, directly to Prezzie, and we may retain, re-issue, or re-offer it in future promotions. Account credit you receive may be withdrawn as cash to an Australian bank account you nominate, subject to these terms.

We will always do our best to fulfil the exact physical prize described in a promotion. In some cases, however, a particular item may be unavailable due to circumstances outside our control — including stock shortages, supplier or manufacturer delays, discontinued lines, model or specification changes, or other availability issues. Where the advertised physical prize cannot reasonably be supplied, we may, at our discretion, substitute a prize of equal or greater value or pay the stated value of the prize to you in Australian dollars (AUD) instead. Cash payments are made by electronic transfer to an Australian bank account you nominate when claiming.

8. Claiming prizes

To receive a prize you must claim it within the time stated for the relevant promotion or otherwise notified to you, and in any case within 30 days of being notified that you have won. Unclaimed prizes may be forfeited or, where required by the relevant permit, redrawn.

Before a prize is awarded or paid we may require you to verify your identity, age, and residential address, and to confirm you meet the eligibility criteria for the promotion. We may withhold a prize until verification is complete and may decline to award a prize to any entrant we reasonably believe is ineligible or in breach of these terms.

You are responsible for any tax consequences arising from a prize. Prezzie does not provide tax advice. As a condition of entry, winners may be required to take part in reasonable publicity and to have their first name, the initial of their surname, and their state published where the relevant trade-promotion permit requires winners to be announced.

10. Billing and renewals

Paid memberships are billed in advance on a recurring basis and automatically renew at the end of each billing cycle until cancelled. By subscribing you authorise us and our payment providers to charge your nominated payment method for each renewal until you cancel. One-time packages and any discounted offers, including post-purchase upsell offers, are charged once at the time of purchase.

We may change subscription prices, package prices, or token allocations from time to time. Where a price change affects a recurring subscription, we will give you reasonable advance notice, and the new price applies from your next billing cycle. If you do not agree to a price change you may cancel before it takes effect.

11. Refunds

Tokens are consumable digital items, and membership gives you immediate access to member benefits — including the full set of member discount codes — as soon as you join. Because that value is delivered straight away, payments are generally non-refundable.

We will, however, consider a refund of a token purchase where none of the tokens from that purchase have been redeemed or used. Once any token from a purchase has been used, that purchase is no longer refundable. Spent tokens, and tokens already used to enter a promotion, are not refundable in any circumstances.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are liable for a failure to comply with a consumer guarantee, our liability is limited to the extent permitted by law. Refunds for purchases made through the Apple App Store or Google Play are handled under section 12.

12. Purchases through the App Store and Google Play

If you purchase a membership, tokens, or any other item through Apple's App Store or Google Play, that transaction is processed by Apple or Google and is also subject to their terms. Billing, payment, and refunds for those purchases are managed by the relevant app store under its own policies, and refund requests for app-store purchases must generally be made to Apple or Google rather than to us. Where an app store's rules conflict with this section for a purchase made through it, the app store's rules apply to that purchase.

13. Cancellation

You may cancel your membership at any time. Tokens already granted at the time of cancellation remain yours to spend for the period they were issued for. Once spent, tokens are not refundable.

14. Suspension and termination

We may suspend or close your account, withhold or reverse tokens, entries, or prizes, and refuse or cancel any entry, where we reasonably believe you have breached these terms, provided false or duplicated information, engaged in fraud or unlawful conduct, exploited a bug or error, or are not eligible to participate. We may also suspend or withdraw the service, or any game or promotion, where required by law, by a regulator or permit condition, or for security, technical, or operational reasons. Where we close your account other than for breach, any unspent tokens are treated as set out in the cancellation section above.

15. Changes to these terms

We may update these terms from time to time. Each version carries a version identifier, and the current version is shown at the top of this page. If we make a material change we will take reasonable steps to notify you, and you may be asked to accept the updated terms. By continuing to use the service after an updated version takes effect, you accept the updated terms. We keep a record of the version you accepted.

16. Limitation of liability

To the extent permitted by law, and subject to your rights under the Australian Consumer Law, the service, games, and promotions are provided on an as-is basis, and we are not liable for indirect or consequential loss, or for loss arising from matters outside our reasonable control, including technical faults, display errors, or service interruptions. Nothing in this section limits any liability that cannot lawfully be limited.

17. Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of your agreement with us. Please read it to understand how we collect, use, and protect your information.

18. Governing law

These terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state. Each promotion is also conducted under the trade-promotion permit or permits and conditions that apply to it; where a permit condition conflicts with these terms for a particular promotion, the permit condition prevails for that promotion.

19. Promoter and contact

This service and the trade promotions run on it are conducted by Selvi Enterprises Pty Ltd trading as Prezzie (ABN 30 657 383 858, ACN 657 383 858), of Suite 329/98-100 Elizabeth Street, Melbourne VIC 3000, Australia (“Prezzie”, “we”, “us”). You can contact us at support@prezzie.au or through support in your account. Each promotion may also name the promoter and permit details in its own conditions. Records of plays and prize awards are retained for regulatory compliance.

20. Electronic communications and marketing

By creating an account you agree that we may send you electronic messages relating to your membership, billing, entries, and prizes; these service messages are necessary to operate your account and are not marketing. With your consent, we may also send you promotional and marketing communications about new promotions, prizes, offers, and features by email, in-app message, or push notification. You may withdraw consent to marketing communications at any time using the unsubscribe link in the message or the notification settings in your account, without affecting service messages. We handle your information as described in our Privacy Policy.
